Forté Chocolate Terms of Service

1. Orders and Purchases

All orders are subject to availability. We reserve the right to refuse or cancel any order for any reason, including pricing errors, product descriptions, or inventory issues. Prices are in USD and exclude taxes and shipping unless stated otherwise. We accept major credit cards and other payment methods via our secure processor. By placing an order, you authorize us to charge your payment method.

2. Shipping and Delivery

Shipping rates and methods are calculated at checkout. We ship primarily to the continental United States (exclusions may apply to certain areas due to carrier limitations). International shipping may be available—contact us for details. Risk of loss passes to you upon delivery to the carrier. We are not responsible for delays, lost packages, or damages after handover to the carrier, though we will assist with claims where possible.

3. Free Shipping or Promotional Shipping Offers

From time to time, we may offer free shipping on qualifying orders (e.g., orders over a certain amount or with a promo code). Any such offer will specify the threshold, eligible regions (typically continental US only; exclusions for AK, HI, or international), code requirements, and restrictions. 5. Other Promotional Terms & Conditions

Promotional offers (discounts, codes, bundles, etc.) are subject to specific terms announced at the time (e.g., via email, social media, or Website). General rules include:

• Discounts apply to merchandise total only (exclude taxes, shipping, or additional charges).
• Valid for a limited time, one use per customer/household unless specified, and cannot be applied to previous orders.
• Exclusions typically apply to: gift cards, custom orders, bulk/wholesale purchases, limited edition or seasonal collections, pre-orders (unless stated), corporate gifting/multi-ship orders, or items not labeled eligible.
• Promotions cannot be redeemed for cash, combined with other discounts/codes/rewards, or used for purchases at our physical boutique (unless specified).
• We reserve the right to withdraw or amend any promotion or these terms at any time.

For corporate gifting or bulk orders: We offer a corporate partnership program with potential special discount codes. Sign up via the relevant page on our Website for details and code delivery.

6. Gift Card Terms & Conditions

Forté Chocolate electronic gift cards are redeemable only for products on fortechocolate.com. Physical gift cards are redeemable only for in-store product purchases. Forté gift cards do not expire (per Washington state law), but are not redeemable for cash except as required by law. Lost or stolen cards will not be replaced. Gift cards cannot be used for previous orders or combined with certain promotions.

7. Review or Contest Promotions (e.g., Golden Ticket or Similar)

From time to time, we may run contests or promotions (e.g., Golden Ticket Contest for prizes like free chocolate for a year). Full rules will be posted on the relevant page (e.g., fortechocolate.com/golden-ticket-contest-rules). Prizes are non-transferable, non-redeemable for cash, and subject to verification. We reserve the right to disqualify entries or modify rules.

8. Returns, Refunds, and Exchanges

Due to the perishable nature of chocolate, we do not accept returns or exchanges except for damage, defect, or error on our part. Contact us within 7 days of receipt at info@fortechocolate.com with photos for review. Approved claims may receive replacement, credit, or refund at our discretion. No refunds for buyer’s remorse or melting due to improper storage/handling after delivery.

9. Intellectual Property and Use of Website

All content on the Website (text, images, logos, product descriptions) is owned by Forté Chocolate or licensed to us and protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without our written permission in advance.

10. Limitation of Liability

To the fullest extent permitted by law, Forté Chocolate’s liability for any claim arising from these Terms or your use of the Website/products is limited to the amount you paid for the relevant product. We are not liable for indirect, incidental, consequential, or punitive damages (e.g., lost profits, data loss). Products are provided “as is” without warranties beyond those implied by law.

11. Governing Law and Disputes

These Terms are governed by Washington state law (USA), without regard to conflict of laws principles. Any disputes shall be resolved exclusively in courts located in Skagit County, Washington.
